I’m going to write about Tom and Kim Deal soon, I promise. Their divorce is probably the ugliest family law matter to ever sully the Alameda County Courts. It has gone on for something like seven years now, has been up to the appellate court a handful of times, has cost Kim a king’s ransom in attorney’s fees – and there seems to be no end in sight.
The problem is that it’s so huge that it’s difficult to get a handle on how to present it. But anybody who wants to read a horror story worthy of Steven King should stay tuned. He did argue (as one of 6 law firms that my former wife hired) before Comm. Glenn Oleon that I should be found to be a vexatious litigant. In spite of the facts and law, I was deemed to be such. Shortly thereafter, this same Oleon was recused from the case in response to my well documented and entirely accurate Judicial Challenge (CCP 170 et. seq.) alleging incompetence and dishonesty. You be the judge. Then P. Judge of Family Law, Yolanda Northridge successfully delayed the proceedings by nearly 9 months, and caused me enormous expense by ordering that Oleon was still in charge of the case, until I pointed out that she lacked jurisdiction to make any such determination (CCP 170.3(c)(5)). She was forced to agree, and I felt that she was only bullying a lay litigant from the Bench, and I’m not that easy to bully.
I am a whitewater guide (10 river in 27 years, over 200 trips, several rescues, no injuries), a Vietnam vet. (you’re welcome!), an advanced SCUBA diver certified by both international organizations, and have served on four Boards of Directors, both by request and election. How easily do you think I’m intimidated by dishonest lawyers?
You’d think that I’m stalking them with a deer rifle with a high powered scope, the way they are behaving. Nope, I enjoy the cross bow, the weapon that changed the wearing of armor forever. With a scope. And a laser sight. And a 400 yard range.

I believe that I should have been allowed to have my own expert witness examine my children, that confidentiality privilege extends to me regarding my childrens’ psychological records, and that Commissioner Elizabeth Hendrickson has earned the D- rating that the public has given her @ http://www.ratethecourts.com/index.php
I further believe that P. Judge Dan Grimmer cannot produce any facts in evidence to support his finding that he “has presided over 3 years of problematic supervision (visits)”. My 11 visitation supervisors uniformly gave me a teriffic rating, especially for the 2 years just before Grimmer’s false statement. (Mr. Andre Russell, SUPER VISITS, 925 698-4472)
The law specifically excluded my need to protect my twin children, then 5 years old, from their mother from the realm of domestic violence. When my children are allowed to talk openly, they will also condemn Judge Grimmer and his personal, undocumented appointment of attorney Dean Feldman to represent my children. Grimmer appears to not have follow protocol for such and appointment, and Feldman removed evidence without permission from the Court, then claimed that he had such. This is not going to go away as long as my children are in danger from their drug-using and violent step father Henry Funke, and their birth mother, the sterile Ms. Kim Funke/Deal.
If you think that it’s ugly now, wait until the rest comes out! I can’t wait for Mr. Dimick to spin it!
